I ordered a bedroom set from a furniture store. When it was delivered, there were two pieces damaged. The store said they would replace the damaged pieces, however after three days I changed my mind totally about the set because of the quality and asked that they come and pick it up and cancel replacing the damage pieces. The manager said she would have to get back with me on it. Two weeks went by and when she called she said that at the bottom of my receipt it says all sales are final. she was unable to answer why she didn't tell me this earlier. she also told me that it was a special order and that's why it couldn't be returned. When I bought it they never told me it was a special order because it was a King size bed. I don't want the set and they refuse to take it back.
Do I have a legal case. what about the fact that the merchandise delivered was damaged. I heard somewhere that the quality of the goods cancels a no return policy. Am I obligated to keep a poor quality set?
Replacing the damaged goods is as much as you can expect. they gave you notice on the receipt
from what i'm aware of, "all sales final" does not apply if the good is defective or does not work as was intended when sold. thats the only exception i know of
You probably have a legal case, but will get screwed when they go out of business finally. My advice: keep calling and take whatever they offer..
Legally, their only responsibility is to replace the damaged pieces, they are not required to take it back because you changed your mind about liking it. Sorry, sucks, but thats the way things are.
You could pursue a legal argument on it, but I don't know what would happen. I don't think that you will be able to return it for a full refund, that's for sure… I would try to get the replacement parts and if anything is wrong with them then you have a better chance at winning, but if nothing is wrong with them, then they can argue that they did their best and you would lose. Sorry, but that's all the advice I can give. Hope it helps you.
Not in my store, I have a legal sign on my front door, and at the cash register. I have never given a refund.
Best get some legal advice on this.usually when a''SALE" of this nature takes place you need to read the fine print in the ad. or take 'em to small claims court. You can file yourself and pocket the Att. fees. I'd sue. If they keep puttin' you off obviously they have taken a 'screw you stance" and you as a consumer do have rights !!
maybe a store credit. other wise, nope
you have no case, ma'am. if it says final sale on the receipt then you are really screwed. also when you sign your name, the aggreement says that you will pay the amount. sell it on ebay toots
However, if the goods were damaged on arrival. maybe.
If it was printed on the reciept or otherwise easily noticable they have the right to stand by the policy.
They must act reasonably…i.e. replace damaged goods….if they take too long that may be a problem…but without a serious delay you don't have a right to a refund
If a store has an "all sales final" policy are there exceptions?
